The Supreme Court’s Big Gun Case Was Humiliating for the Justices

For Zackey Rahimi, pointing a rifle in the approximate direction of an issue seems to be the answer to almost any difficulty in life. He threatened to shoot his girlfriend if she notified anybody about his pushing of her in a parking lot in December 2019, after firing a shot at an onlooker who had witnessed it. He discharged an AR-15 into his acquaintance’s house after they made a derogatory social media remark about him. He shot at the other motorist in an automobile collision; when a truck swung its lights at him on the freeway, he pursued the driver off the exit and, strangely, fired at a separate vehicle that was trailing the offending truck. Rahimi pulled out a revolver and fired several shots into the air after his friend’s credit card was denied at a Whataburger. I doubt that this decision made the frightened employees any more likely to comply with his instruction.
When the Supreme Court heard oral arguments on Tuesday over Rahimi’s request to retain his cherished firearms, none of this was in question. However, Justice Clarence Thomas asserted that there was only a “very thin record” in the case, therefore it was also not a hot matter of discussion. It appears that enough conservatives will side with the court’s progressives in rejecting Rahimi’s petition, even in the face of the court’s incapacity (or unwillingness) to draw attention to the awful realities of his case.
In case it wasn’t evident previously, Zackey Rahimi hasn’t proven that he can handle a gun in a safe manner. A Texas state court issued a protective order at the beginning of 2020, prohibiting him from owning firearms and directing him to avoid contact with his ex-girlfriend. However, Rahimi was charged with breaking a federal law that forbids people covered by protective orders from owning firearms when police searching his room during the investigation of the subsequent shootings discovered a pistol, a rifle, and ammunition for both. Rahimi argued in federal district court that the statute violated his Second Amendment rights, but the judge was not persuaded. In June 2022, a three-judge panel of the most conservative federal appeals court in the nation, the U.S. Court of Appeals for the 5th Circuit, upheld the state’s authority to seize Zackey Rahimi’s firearms.
But a few weeks later, Rahimi was given permission by the Supreme Court to reclaim his firearms. In New York State Rifle & Pistol Association v. Bruen, the court held—in an opinion written by Thomas—that limitations on the right to bear arms are presumed to be unconstitutional unless they are, in the learned opinion of a judge, consistent with the country’s “historical tradition of firearm regulation.” In Rahimi’s case, the 5th Circuit withdrew its opinion and issued a new one in which it expressed a different opinion: Judge Cory T. Wilson stated that while the law reflects “salutary policy goals,” “our ancestors would never have accepted” it. Stated differently, current lawmakers are helpless to stop the average of 70 women who are shot and killed each month by domestic abusers because the Framers failed to disarm them.
Justice Ketanji Brown Jackson, during oral arguments, frequently emphasized that since Bruen, lower court judges using its standard have been, to use a legal jargon, all over the place. Jackson sought any kind of guidance on how the court should interpret its own decision. Lower courts are similarly perplexed, to reiterate. A federal legislation disarming those convicted of specific crimes may not have passed constitutional muster, according to one court that upheld Florida’s restriction on the sale of firearms to 18 to 20-year-olds.
A few judges have expressed in public how frustrated they are with law-office history’s unexpected analytical supremacy. One in 2022 stated, “We are not experts in what white, wealthy, male property owners thought about the regulation of firearms in 1791.” “But in the name of constitutional adjudication, we are now expected to play historian.” The court was criticized by another for establishing a “historical Where’s Waldo”-like game that leaves district courts with “mountains of work to deal with Bruen-related arguments in nearly every criminal case in which a firearm is found.”
The Supreme Court heard oral arguments in Rahimi’s case on Tuesday, marking the court’s first significant Second Amendment issue since Bruen. In the case of United States v. Rahimi, the legal issue is whether the federal statute that Rahimi was found guilty of violates the Second Amendment. The practical concern is whether the court took its ruling in Bruen so literally that any attempt at legislation to solve the nation’s current gun murder crisis had to yield to the views of James Madison, who lived almost 250 years ago, as Clarence Thomas imagines him to have.
The extent to which “history and tradition” supports a current law was the main topic of discussion on Tuesday. Thomas stated in Bruen that while the government must find a historical “analogue,” it need not find a historical “twin.” Naturally, though, opinions on just how intimate a family bond should be diverge on both sides. The government in Rahimi contends that enforcing the law is sufficient given its “history and tradition” of disarming “dangerous” individuals. Rahimi contends that the government must reinstate his right to carry a pistol when he is denied access to the fast-food hamburger of his choosing because there is allegedly no “history and tradition” of total restrictions on gun ownership.
Similar to Captain Smith’s audacious decision to steer the Titanic into an iceberg field, this argument is audacious. Since the current notion of protective orders was not present before the founding, the lack of legislation prohibiting individuals under protection orders from possessing firearms may not be as definitive as one might assume from an ordinary lifetime member of the National Rifle Association. Additionally, weapons of today are far deadlier than those of the colonial era: According to an amicus brief filed by a gun safety group, the perpetrator of almost two-thirds of deadly mass shootings between 2014 and 2019 either killed at least one partner or family member or had a history of domestic violence. The fact that the Framers did not disarm abusers in 1791 does not imply that they would not have done so in the case of a real-life epidemic of deadly intimate partner violence, even if abusers in 1791 murdered as many people as they do in 2023.
A few justices expressed worries about the issues that arise from giving legislators and judges the authority to decide someone qualifies as “dangerous” or “irresponsible” enough to forfeit their Second Amendment rights. But nobody appeared to believe that Zackey Rahimi wouldn’t be able to qualify. Chief Justice John Roberts questioned J. Matthew Wright, Rahimi’s attorney, if he would acknowledge that his client is a “dangerous person.” Ever the fervent advocate, Wright sought clarification on the meaning of the term. “Well, it means someone who’s shooting, you know, at people,” Roberts said incredulously. That’s a fantastic place to start,” the gallery chuckled nervously.
Faced with a challenging combination of facts, Wright advanced a different, more focused argument: that Rahimi was not given enough time by the relevant law before the authorities confiscated his firearms. However, Rahimi’s case is not a due process challenge under the Second Amendment, and some justices became irritated with Wright for sidestepping the issue. Roberts, Justices Sonia Sotomayor and Neil Gorsuch, and Roberts all made different suggestions at different times that fixing issues with civil protection order procedures is just a job for another day. Roberts questioned, “Why isn’t that the end of the case if there are circumstances where someone could be shown to be sufficiently dangerous that the firearm can be taken from him?”
The criticism from Justice Elena Kagan was considerably more scathing. She stated that Wright’s reasoning would put in jeopardy a “wide variety” of laws that disarm those who pose a “obvious” risk to others. “I feel like you’re running away from your argument, you know, because the implications of your argument are just so untenable that you have to say, ‘No, that’s not really my argument,'” the woman said. “I suppose I’m asking you to elaborate on your position, as it appears that you’re trying to avoid it because you can’t bear the implications.”
It appears likely that the court will veer away from the most severe interpretation of Bruen after oral argument. (As Linda Greenhouse of the New York Times pointed out, many of the Second Amendment amici in Bruen are noticeably silent in Rahimi because, let’s face it, even the most adamant supporters of gun rights in the conservative legal movement probably do not want to see the headline “SUPREME COURT UPHOLDS GUN RIGHTS OF DOMESTIC ABUSERS” splashed across the top of, well, the New York Times.) Jackson once brought up the case’s significance in light of the most recent mass shooting in Maine, which claimed the lives of eighteen people. For legislators whose constituents, as Jackson put it, are begging them to “do something,” but who are currently unsure of what the court will allow, a Rahimi decision that makes Bruen clear would be welcome news.
If the Tuesday’s sessions caused the justices any annoyance or embarrassment, it is all their own fault. Wright’s arguments on Rahimi’s favor stem from Bruen, a legal disaster that Clarence Thomas printed on Supreme Court letterhead while organizing his opulent summer vacation itinerary. As long as the court is dominated by a conservative six-justice supermajority, things like this will sporadically occur. Whenever Thomas and Company are eager to recast Federalist Society doctrine as constitutional law, they will occasionally create a mess that they will have to clear up afterward.

To view the controllers connected to your console, navigate to Controllers > Find Controllers.
If the missing controller has fallen behind the sofa or under the bed, you can locate it by highlighting it and pressing the L or R button on the one you have. If not, it should vibrate. To make both Joy-Cons vibrate in case you lose them, tap the touch screen.
We adore the Nintendo Switch, but if you primarily use digital downloads, you may quickly run out of space once you’ve accumulated a library of games due to the device’s lackluster hard drive capacity. Archiving games that you aren’t playing right now is one way to solve the problem. While maintaining game saves, this frees up space.
Simply select Manage Software > Archive Software after highlighting the game and pressing +. System Settings > Data Management is another way to archive. Press ‘A’ to bring up the Sharing and Editing options when you open the screenshot on your Switch, and then choose Send to Smartphone. Maria Menounos Saw Signs of Pancreatic Cancer a Year Before Her Diagnosis — Here’s What Doctors Missed
In December 2022, about a year and a half ago, Maria Menounos received the horrifying news that she had pancreatic cancer. Since then, the TV and podcast host has had surgery to remove the tumor along with her spleen, a fibroid, and 17 lymph nodes. She has also turned into an ardent supporter, striving to increase public awareness of the illness. It’s a crucial job since, according to the Pancreatic Cancer Action Network (PanCAN), pancreatic cancer can be difficult to diagnose because the organ is situated too deep in the abdomen for medical professionals to feel or see tumors, and because symptoms aren’t always evident. Menounos’s route to a diagnosis, which included several missed indications and months of doctor appointments, serves as an example.
During a recent episode of Hoda Kotb’s podcast, Making Space, Menounos talked about how she had been experiencing severe bloating for several months prior to receiving her diagnosis. Eight months before receiving a pancreatic cancer diagnosis, in April 2022, Menounos suggested that her pancreas might be the issue on an episode of her own podcast, Heal Squad. Menounos recounted the incident, saying, “[I said,] ‘I think something’s wrong with my pancreas,'” and that “a whole discussion about the pancreas” ensued. She described her remarkably precise prediction as “so random.”
Menounos began to have new-onset diabetes in June 2022, which is another sign of pancreatic cancer. Menounos recalled, “I said, ‘I don’t have this,’ first.” “I have no reason to develop Type 1 diabetes at 43 years old or older.” In retrospect, it appears that doctors overlooked this further warning indication. Research suggests that newly developing diabetes in adults over 50 “may be an early symptom of pancreatic cancer,” according to PanCAN. having diarrhea and what she had previously described as “excruciating” stomach discomfort. Menounos’s agony persisted even after CT scans, blood tests, and stool examinations revealed nothing abnormal. Ultimately, a growth on her pancreas was discovered during an MRI in December 2022. A biopsy later identified the abnormality as a stage 2 pancreatic neuroendocrine tumor.
Menounos was fortunate to have been diagnosed with cancer at an early stage and to have had the means to receive treatment. However, during the course of the year, Menounos’ doctors missed several symptoms even with those resources. The E! News alum is committed to sharing her experience because it validates the strength of persistence and self-advocacy in the doctor’s office.
Menounos stated earlier this month in a PanCAN ad that the best thing you can do for your health is “early detection, paying attention to your body and the signals it’s giving you.” “I want people to realize that they need to pay attention and take charge of their health.” According to PanCAN, signs of pancreatic cancer specifically can include back or abdominal pain, sudden-onset diabetes, jaundice, nausea, loss of appetite, changes in stool, and enlargement of the pancreas (also known as pancreatitis).
It’s important to be aware of the signs of cancer and other health problems and to make sure that medical professionals give your worries due consideration. Menounos emphasized, “You can’t just listen to somebody else tell you what’s happening in your body.” “If the suffering continues, you must not give up.”

In a statement to 8 News Now after the arrest, he stated, “We all must be held accountable for our choices.” “In our community, we should be able to live in harmony and experience love! For me, justice is just now beginning to be understood. For me as a father, a big part of justice is identifying the real reasons why, at this age, our kids choose violence—the underlying causes, the fear of ongoing resource conflict and reliance on a dysfunctional system—and creating our own self-regulated riches and health instead!
Two persons who were still unidentified were requested to be identified by police. As of Tuesday afternoon, neither of the two’s photos had been made public.
