Même les militaires comptaient des non-juifs dans leur rang, dit encore Daniel. Il y avait des Druzes [une communauté issue de l’islam], mais aussi des Israéliens originaires de l’Inde.

L’organisme visé par une plainte

Au Canada, la loi interdit à quiconque d’inciter une autre personne à s’enrôler dans des forces armées d’un État étranger, sauf si le recrutement est mené par des diplomates auprès de ressortissants de leur propre pays.

C’est ce que confirme le ministre canadien de la Justice dans un courriel envoyé à Radio-Canada.

La Loi sur l’enrôlement à l’étranger interdit à toute personne de recruter au Canada une personne pour s’enrôler dans les forces armées d’un État étranger ou dans une autre pressure armée opérant dans cet État.

Par forces armées, la loi canadienne inclut les forces ou les providers de l’armée, de la marine et de l’aviation, mais exclut les […] activités humanitaires pour la Croix-Rouge canadienne, toujours d’après le ministère.

Sar-El au Canada a déjà été visé par une poursuite en septembre 2022, mais le Service des poursuites pénales du Canada (SPPC) a mis fin aux accusations deux mois plus tard, à la demande de la Couronne fédérale, selon l’un des avocats des plaignants, Shane Martinez.

La poursuite a été intentée par David Mivasair, un rabbin établi en Ontario, et Rehab Nazzal, une artiste canadienne d’origine palestinienne.

L’affaire n’est pas tout à fait shut, puisque les plaignants comptent faire appel de la décision de la Couronne, selon leur avocat. Le 7 novembre, nous serons présents à la Cour d’appel de l’Ontario pour cette affaire, a dit Me Martinez, accusant le gouvernement d’avoir agi de mauvaise foi, à des fins politiques.

Le SPPC a confirmé à Radio-Canada qu’une viewers d’appel est prévue au début du mois de novembre.

Évitez tout voyage en Israël, dit le Canada

Shane Martinez, qui représente également le Centre worldwide de justice pour les Palestiniens, explique que le fait qu’Israël soit aujourd’hui en guerre est un argument à prendre en considération pour empêcher le recrutement de Canadiens dans les bases militaires de ce pays. Il rappelle par ailleurs que l’État hébreu fait face à des allégations de génocide devant la Cour internationale de justice de l’ONU.

Selon Me Martinez, les activités de Sar-El représentent une violation flagrante du droit canadien.

Imaginez si une organisation au Canada recrutait des bénévoles pour l’armée russe. Ces bénévoles s’installeraient sur des bases militaires en Russie et porteraient des uniformes militaires russes. Ils seraient chargés de réparer des armes russes et de nettoyer des chars russes… Le gouvernement ne le permettrait pas une seule seconde.

Dans une lettre justifiant le retrait des accusations par la Couronne et déposée en décembre 2023 auprès de la Cour d’appel de l’Ontario, le SPPC affirme qu’il n’existe aucune preuve que Sar-El Canada recrute ou incite de quelque autre manière une personne ou un groupe de personnes à s’enrôler ou à accepter une fee ou un engagement dans les forces armées d’Israël.

Dans leur utility, les bénévoles reconnaissent qu’ils n’ont pas l’intention de servir, de rejoindre ou de prêter allégeance à l’armée israélienne, peut-on encore lire dans cette lettre signée par un avocat du SPPC, Marten Dykstra.

Le easy fait qu’une personne fournisse un service à une armée étrangère ne constitue pas un engagement au sens […] de la Loi sur l’enrôlement à l’étranger, écrit-il.

Bien qu’il existe un lien entre le bénévole et l’armée israélienne, il n’existe aucune preuve d’une relation formelle.

Au whole, il y a actuellement plus de 6000 Canadiens en Israël, selon les données d’Affaires mondiales Canada.

Depuis août, le gouvernement canadien recommande à ses citoyens d’éviter tout voyage en Israël en raison du conflit armé régional en cours et de la state of affairs imprévisible en matière de sécurité.

La state of affairs en matière de sécurité peut se détériorer davantage sans préavis, met en garde Affaires mondiales Canada.

L’insécurité dans la région ne semble toutefois pas refroidir les ardeurs de Daniel, qui n’hésiterait pas à se rendre une troisième fois en Israël dans le cadre du programme de bénévolat de Sar-El.

C’est un travail necessary, dit-il. Les forces israéliennes ont besoin de toute l’aide potential.
